Landlord may recapture this Lease so that the prospective sublessee or assignee (except in the event of a sublease of a portion of the Demised Premises, Tenant shall be only released with respect to any and all obligations pertaining to such portion of the Demised Premises which is recaptured) shall become the direct tenant of Landlord hereunder and Tenant shall be fully released from any and all obligations hereunder (or, in the event of a sublease of a portion of the Demised Premises, Landlord may recapture such portion of the Demised Premises) except such obligations accruing prior to the date of termination,

Tenant and any suble,ssee or assignee shall promptly pay to Landlord any and all consideration received for any assignment or subletting from an assignee or sublessee that does not acquire Tenant’s business or a material part thereof and which continues Tenant’s operation at the Demised Premises as and when received in excess of the rent required to be paid by Tenant for the area assigned or sublet, computed on the basis of an average rent per rentable square foot area assigned or sublet

6. Tenant and Landlord shall each secure an appropriate clause in, or an endorsement upon, each insurance policy obtained by it covering or applicable to the Demised Premises

Помогите понять смысл выделенного.

9. institution of any summary dispossession action or any other action instituted as a result of Tenant’s default;
10. founded upon a claim that the substance of the aforesaid representation of the indemnifying party is untrue
