What is an award?
An award is a legally binding document containing
wages and conditions of employment in an organisation or industry. These
conditions have been negotiated over a period of time between the employers and
unions and have been made by either the Australian Industrial Relations
Commission, which is the Federal jurisdiction, or by a State Industrial
Relations Tribunal. Awards generally specify the minimum wages and conditions
an employer must provide.
Over time, awards have included many different
working conditions and there has been no restriction on matters that could be
included. However, the federal Workplace Relations Act 1996 now
prescribes the issues that may be considered in federal awards and limits them
to twenty 'allowable award matters': These are listed in the background
notes.
There is no such restriction on allowable conditions
in state awards.
Awards may cover an industry or an occupation or in
some cases, a particular business.
An example of a federal award is the 'Australian
Liquor Hospitality and Miscellaneous Workers Union Supported Employment
(Business Enterprises) Award 1993', as varied to 31st August 2001.
What is an award
exemption?
In some states the industrial relations legislation
provides for employers to apply for an exemption from paying award rates of
pay. Business services may have applied for, and have been granted, such an
exemption. It should be noted that a business service that is using a state
based exemption does not automatically meet the provisions of
Standard 9.
