The English term often used is suretyship, and emphasis must be laid on the guarantee text, not the heading. An accessory guarantee may also be called a conditional guarantee. What is typical for an accessory guarantee is that the obligations of the guarantor are accessory to that of the principal under the underlying contract. This means that the obligations of the bank as the guarantor can never exceed the obligations of the principal as the contracting party.
